Apr 20, 1948
334 Ill. App. 263 (Ill. App. Ct. 1948)

Opinion

Gen. No. 10,234. (Abstract of Decision.)

Opinion filed April 20, 1948 Released for publication May 10, 1948

DIVORCE, § 228foreign decree for support of child based on service by publication. That part of a divorce decree rendered by an Oregon court which ordered defendant to pay monthly amounts for child support, being in effect a judgment in personam, was void where court's jurisdiction rested upon service by publication and defendant, a resident of Illinois, had no notice of publication, was not served with personal process, and did not appear in divorce proceedings; hence defendant could not be held in contempt for failure to pay sums accrued under decree.

See Callaghan's Illinois Digest, same topic and section number.

Appeal from the Circuit Court of LaSalle county; the Hon. Louis A. ZEARING, Judge, presiding.

Decree affirmed. Heard in this court at the February term, 1948.

Floyd L. Benson and Arthur E. Colwell, for appellant;

Harold R. Langer and Hibbs Pool, for appellee.
