MEMORANDUM OPINION


Appellant, Wiley Ann Blanks Bingham, Independent Executrix of the estate of Jerry Glenn Bingham, appealed from the probate court's partial grant of appellee Wade McClanahan's motion for summary judgment. Appellant has filed a Motion To Dismiss Appeal on the grounds that the parties have settled this matter. We conclude that Appellant's motion should be granted and we hereby dismiss the appeal. See Tex.R.App.P. 42.1(a)(1).
