ORDER
This 18th day of January 2002, having carefully considered the appellant's opening brief and the State's motion to affirm, we find it manifest that the judgment of the Superior Court should be affirmed on the basis of the Superior Court's well-reasoned decisions dated May 3, 2000 and September 26, 2001. The issues on appeal are controlled by settled Delaware law. To the extent the issues are ones of judicial discretion, we find no abuse of the Superior Court's discretion.
NOW, THEREFORE, IT IS ORDERED that the judgment of the Superior Court is AFFIRMED.
