Opinion

Gen. No. 40,901. (Abstract of Decision.)

Opinion filed May 20, 1940

FORECLOSURE OF MORTGAGES, § 215confirmation of sale. Foreclosure sale was properly approved, where record did not support defendant's assertion that sale was not for cash, and alleged higher bid by defendant was not in cash, but was a decree upon a creditor's bill, which had previously been held inferior to plaintiff's right under the trust deed.

See Callaghan's Illinois Digest, same topic and section number.

Affirmed. Heard in first division, first district, this court at April term, 1939.
