PAMELA ALEXANDER, Appellant v. WILMINGTON SAVINGS FUND SOCIETY, FSB D/B/A CHRISTIAN TRUST AS TRUSTEE, Appellee
On Appeal from the 95th Judicial District Court Dallas County, Texas
Trial Court Cause No. DC-15-05000
ORDER
Before the Court is appellant's August 7, 2017 second pro se motion to extend time to file appellant's brief. A review of the proceedings in this Court reveals the briefing deadline was inadvertently set before the reporter's record was filed. We note we previously informed appellant that the court reporter had notified us the reporter's record had not been requested. We directed appellant at that time to file written verification she had requested the record and either paid or made arrangements to pay for the record or was entitled to proceed without payment. We cautioned appellant that failure to comply could result in the appeal being submitted without the reporter's record. TEX. R. APP. P. 37.3(c). However, to date, appellant has not replied. Accordingly, we ORDER the appeal submitted without the reporter's record. TEX. R. APP. P. 37.3(c).
We further ORDER appellant to file her brief by September 11, 2017. We DENY as moot appellant's extension motion. We note, however, the motion fails to include a certificate of service and certificate of conference as required by the Texas Rules of Appellate Procedure 9.5 and 10.1(a)(5). All further filings with this Court shall comply with these rules. See TEX. R. APP. P. 9.5; 10.1(a)(5).
