Appeal from the 384th District Court of El Paso County, Texas (TC# 2014DCV0484)
Before Alley, C.J., Palafox and Soto, J.J.
ORDER
Pursuant to Texas Rule of Appellate Procedure 10.4 (a) the motion ruled on through this Order may have been decided by a single Justice sitting on the panel.
The reporter's record in this cause was due to be filed on or before April 4, 2024. By Order dated April 8, 2024, this Court granted court reporter Kathi Supnet's request for extension of time to file the reporter's record and ordered the reporter's record due on or before May 19, 2024. By Order dated May 30, 2024, this Court granted Ms. Supnet's second request for an extension and ordered the reporter's record due on before June 18, 2024. When no reporter's record was filed, the Clerk of this Court reached out to Ms. Supnet by phone to inquire about the status of the reporter's record. Ms. Supnet informed the Court on June 21, 2024 that she would be filing an extension requesting additional time to file the reporter's record. As of the date of this Order, no third extension request has been received.
It is therefore ORDERED that court reporter, Kathi Supnet, file the reporter's record in this Court no later than July 16, 2024. If the record is not filed by such date, an order will be issued directing Mr. Supnet to appear before this Court and show cause why she should not be held in contempt for failing to file the record. The Clerk of this Court shall cause a copy of this order to be served on Ms. Supnet by certified mail, return receipt requested, or give other personal notice of this order with proof of delivery. Because "[t]he trial and appellate courts are jointly responsible for ensuring that the appellate record is timely filed," Tex.R.App.P. 35.3(c), the Clerk of this Court is directed to serve a copy of this order on the Honorable Patricia Garcia, Judge of the 384th Judicial District Court.
IT IS SO ORDERED.
