ASSOCIATIONS, § 8dues, liability for. In action by employers' association against former member for dues and assessments, where constitution provided that members in arrears for 15 days should be notified and, upon failing to pay within 10 days could either "expel or suspend for nonpayment of dues as the Board of Governors may prescribe," and defendant had tendered its resignation because of inability to pay dues, lower court properly entered judgment for plaintiff only for amount of dues owing at time of resignation, as defendant had right to believe that it had been expelled or its resignation accepted, so as to cut off running of dues.

Appeal from Municipal Court of Chicago; Hon. JOHN T. ZURIS, presiding.

Affirmed. Heard in third division, first district, this court at December term, 1939.
