ORDER
On March 12, 2019, the Court of Appeals for the District of Columbia Circuit
granted, in part, the petition for review in the above-captioned matter and remanded
these cases to the Board for further proceedings consistent with the Court's opinion.
918 F.3d 126 (D.C. Cir. March 12, 2019). On June 6, 2019, the Board accepted the
remand and invited the parties to file statements of position with respect to the issues
raised by the remand. On June 25, 2019, the Region, noting that the Union had
submitted letters disclaiming interest in the subject bargaining unit and requesting
withdrawal of all unfair labor practice charges related to that bargaining unit, referred the
Union’s request to the Board and sought “clarification” as to how the Board intends to
proceed.
Given the Union’s disclaimer of interest and request to withdraw its unfair labor
practices, the Board no longer seeks position statements, and remands these cases to
Region 31 for further appropriate action consistent with the Union’s request.
