Judgment – Request for Adverse 37 C.F.R. § 41.127(b) Interference No. 105,965 2 Pursuant to Rule 41.205(a) and former 35 U.S.C. §135(c), Junior Party Namiki submitted a settlement agreement reached between Junior Party Namiki and Senior Party Nidec, and requested that the settlement agreement be kept separate from the interference file. Paper 19. Pursuant to the Board’s recommendation, via email from paralegal on November 19, 2013, Junior Party Namiki also filed a Request for Adverse Judgment under 37 C.F.R. §41.127(b)(1) with prejudice against Junior Party Namiki having attached thereto a request for Express Abandonment under 37 C.F.R. § 1.138 of the involved Patent Application Serial Number 10/539,036. Paper 21. A conference call to review the status of the settlement negotiations and to discuss the parties’ list of proposed motions was scheduled on November 27, 2013 at 11:00 a.m. EDT as per Paper No. 18. However, in view of the request for adverse judgment, the conference call is no longer necessary and is therefore canceled. Junior Party Namiki’s Request for Adverse Judgment is GRANTED. Accordingly, it is: ORDERED that judgment on priority is entered against Junior Party Namiki; FURTHER ORDERED that claims 29-40 of Junior Party Namiki Patent Application Serial Number 10/539,036, which correspond to Count 1, the sole Count of the Interference (Paper 1 at 4-5), are finally refused. Former 35 U.S.C. §135(a); and FURTHER ORDERED that a copy of this judgment shall be entered into the administrative record of the involved Namiki application, Serial No. 10/539,036 and the involved Nidec patent, US Patent No. 7,023,114.
