R-743 to R-746, inclusive CERTIFICATION OF REPRESENTATIVES March 2, 1939 On November 12, 1938, the National Labor Relations Board, herein called the Board , issued a Decision and Direction of Elections 1 in the above -entitled cases . The Direction of Elections provided that elections by secret ballot be conducted as soon as convenient, and beginning as promptly as practicable after the date of the Direction : 1. Among the licensed deck officers, including masters, employed by Tide Water Associated Oil Company on vessels operating out of At- lantic and Gulf ports to determine whether they desire to be repre- sented by United Licensed Officers of the United States of America; National Organization Masters, Mates, and Pilots of America; or Tidewater Tanker Officers Association , for the purposes of collec- tive bargaining , or by none of them; and 2. Among the licensed engineers employed by Tide -Water Asso- ciated Oil Company on vessels operating out of Atlantic and Gulf ports to determine whether they desire to be represented by United Licensed Officers of the United States of America , Marine Engi- neers' Beneficial Association , or Tidewater Tanker Officers Associa- tion , for the purposes of collective bargaining , or by none of them. Pursuant to the Direction , elections by secret ballot were conducted on 16 vessels operated out of Atlantic and Gulf ports by Tide Water Associated Oil Company . Full opportunity was accorded to all of the parties to this investigation to participate in the conduct of the secret ballot and to make challenges . On January 14, 1939 , Elinore M. No exceptions to the Intermediate Report have been filed by any of the parties. As to the balloting and the results thereof, the Regional Director reported as follows : 1. By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Rela- tions Act and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 1, as amended, IT is HEREBY cERTiFimD that Tidewater Tanker Officers Association has been designated and selected by a majority of the licensed deck 2 This figure does not include the four individuals whose votes were challenged, since the challenges were directed to the question of eligibility. TIDE WATER ASSOCIATED OIL COMPANY ET AL. 891 officers, including masters, employed by Tide Water Associated Oil Company on vessels operating out of Atlantic and Gulf ports, as their representative for the purposes of collective bargaining, and that, pursuant to Section 9 (a) of the Act, Tidewater Tanker Offi- cers Association is the exclusive representative of all such employees for the purposes of collective bargaining in respect to rates of pay, wages, hours of employment, and other conditions of employment; and IT IS HEREBY CERTIFIED that Tidewater Tanker Officers Association has been designated and selected by a majority of the licensed engi- neers employed by Tide Water Associated Oil Company on vessels operating out of Atlantic and Gulf ports as their representative for the purposes of collective bargaining, and that, pursuant to Section 9 (a) of the National Labor Relations Act, Tidewater Tanker Offi- cers Association is the exclusive representative of all such employees for the purposes of collective bargaining in respect to rates of pay, wages, hours of employment, and other conditions of employment.
