AMERICA, ,#12 Case No. R-628 CERTIFICATION OF REPRESENTATIVES October 25, 1939 On October 3, 1939, the National Labor Relations Board, herein called the Board, issued a Decision and Direction of Election' in the abiove-entitled proceeding. On October 11, 1930, the Board issued an Amendment to Direction of Election.2 The Direction of Election, as amended, provided that an election by secret ballot be conducted within twenty-five (25) days from the date of the Direction among the employees of The Toledo Steel Tube Company, Toledo, Ohio, herein called the Company, within the groups described below who were employed by the Company during the pay-roll period next preceding this Direction of Election, including employees who did not work during such pay-roll period because they were ill or on vacation, and employees who were then or have since been temporarily laid off, but excluding those who have since quit or been discharged for cause: 1. The tool and die makers, to determine whether they desired to be'represented by the -Mechanics-Educational- Society • of America, Local No. 4, by 'International Union, United Automobile Workers of America., affiliated with the Congress of Industrial Organizations, for the purposes of collective bargaining, or by neither; 2. All the remaining employees of the Company, excluding clerical and supervisory employees, to determine whether or not they desired to be represented by International Union, United Automobile Workers of America, affiliated with the Congress of Industrial Organizations, for the purposes of collective bargaining. Pursuant to the Direction of Election, as amended, an election by secret ballot was conducted on October 12, 1939, at Toledo, Ohio, under the direction and supervision of the Regional Director for the Eighth Region (Cleveland, Ohio). Section 9 (a) of the National Labor Relations Act, Mechanics Educational Society of America, Local No. 4, is the exclusive representative of all such employees for the pur- poses of collective bargaining in respect to rates of pay, wages; hours of employment, and other conditions of employment; and THE TOLEDO STEEL TUBE COMPANY 413 IT Is HLREEY FURTHER CERTIFIED that International Union, United Automobile Workers of America, Local No. 12, affiliated with the Congress of Industrial Organizations, has been designated and se- lected by a majority of all the -remaining employees of the Company, excluding clerical and supervisory employees, as their representative for the purposes of collective bargaining, and that, pursuant to Sec- tion 9 (a) of the-National Labor Relations Act, International Union, United Automobile Workers of America, Local No. 12, affiliated with .thp Congress of Industrial Organizations, is the exclusive represent- ative of all such employees for the purposes of collective bargaining in respect to rates of pay, wages, hours of employment, and other conditions of employment.
