(“Petitioner”) and Synkloud Technologies, LLC (“Patent Owner”) to file a motion to terminate the instant proceedings. On November 22, 2021, and pursuant to 35 U.S.C. § 317 and 37 C.F.R. § 42.74, Petitioner and Patent Owner filed a joint motion to terminate these proceedings and a joint request to have their settlement agreement (Exhibit 2043) treated as confidential business information under 35 U.S.C. § 317 and 37 C.F.R. § 42.74. Papers 23, 24. In the joint motion, the parties represent that the settlement agreement is with “regard to the patent[] at issue in these proceedings” and is a true and correct copy. Paper 23, 2–3.3 At this juncture of the proceedings, the Board has not entered a final decision. Based on the facts presented in these cases, we determine that it is appropriate to terminate these proceedings. Accordingly, it is: ORDERED that the joint request that the settlement agreement (Exhibit 2043) be treated as business confidential information to be kept separate from the patent files is granted; FURTHER ORDERED that the joint motion to terminate these proceedings is granted; and FURTHER ORDERED that these proceedings are terminated. 3 The pages of the motion are not numbered.
