DECISION AND DIRECTION OF ELECTIONS STATEMENT OF THE CASE Upon petitions duly filed- by Standard Refinery Union, Inc., herein called the Union, each alleging that a question affecting commerce had arisen concerning the representation of employees of Standard Oil Company of New Jersey (Bayonne Refinery), Bayonne, New Jer- sey, herein called the Company,' the National Labor Relations Board consolidated the cases and provided for an appropriate hearing upon due notice before John-J. Cuneo, Trial Examiner. Said hearing was held at Jersey City, New Jersey, on May 31, 1944. The Company and the Union appeared, participated, and were afforded full op- portunity to be heard, to examine and cross-examine witnesses, and to introduce evidence bearing on the issues. Upon the entire record in the case; the Board makes the following: FINDINGS OF FACT r I. THE BIISINESS . OF THE COMPANY Standard Oil Company of New Jersey, a Delaware corporation, is a wholly owned subsidiary, of Standard Oil Company, a New Jersey 'corporation. The Company is engaged in the refining of crude petro- leum and the production, sale, and distribution of gasoline and al- lied products. It maintains it principal office in the State of Dela= ware and an executive office and place of business in New York ,City. It owns and operates, refineries in Maryland, South Carolina, and New Jersey. Only its Bayonne, New Jersey, Refinery (including the Eagle Division located at Jersey City, New Jersey) is involved in, the present proceeding. The Bayonne Refinery, together with a re- finery located at Bayway, New Jersey, comprise the Company's New Jersey Works. During the year 1943, over 36,500,000 barrels of crude oil, valued in' excess of $58,400,000 were purchased by the Company_ from points outside the State of New Jersey, for use at the New Jer-, sey Works: During the same period, the Company refined at its New Jersey Works approximately 1,944,729,000 gallons of petroleum and allied products, having a refined value in excess of $137,565,000. Sub- stantially more than 50 percent of these products was, shipped from the New Jersey Works to points outside the State of New Jersey. The Company admits that it is engaged in commerce within the, meaning of the National-Labor Relations Act. II. THE ORGANIZATION INVOLVED . Standard Refinery Union, Inc., is an unaffiliated labor, organization admitting to membership employees of the Company in the State of New Jersey.,* ' - III. THE' QUESTIONS CONCERNING REPRESENTATION On December 14, 1943, the Union mailed a letter to the Company in which it claimed to represent a majority of the employees at the Bay- onne Refinery (including the Eagle Division) and requested recogni- tion as, the exclusive bargaining representative of such employees. In a reply dated December 17,1943, the Company informed the Union, in substance, that it would not extend recognition in the absence of a certification by the Board. A similar exchange of letters to the same effect took place on January 19 and 20, 1944. 1592 DECISIONS OF NATIONAL LABOR RELATIONS BOARD ' Statements of a• Field Examiner of the Board, introduced into evi- dence at the hearing, have been compiled in a table below.2 These statements indicate that the Union represents a substantial number of employees in each of the five units it alleges to be appropriate. We find that questions affecting commerce have arisen concerning the representation of employees of the Company, within the meaning of Section 9 (c) and Section 2 (6) and (7) of the Act. IV. THE APPROPRIATE UNITS We find, in accordance with stipulations of the parties, that each of the following constitutes a unit appropriate for the purposes of collec- tive bargaining, within the meaning of Section 9 (b) of the Act : (1) All operating, mechanical, and maintenance employees in the Mechanical. Process, and Shipping Departments, and in the Package Division'and Eagle Division of the Bayonne Refinery, including all inspectors and checkers, stprehouse•eountermen and floormen, fire de- partment employees, janitors.and utility men, truck drivers and chauf- feurs.. portco, unit men, inter-refinery pipe-line operators, and non- militarized guards, but excluding all militarized guards, the New York package inspector, all clerical employees in the factory and general offices, all professional and technical employees, all laboratory em= ployees, and all executives and supervisors with authority to hire, promote, discharge, discipline, or otherwise effect changes in the status of employees, or effectively recommend such action." V. THE DETERMINATION,OF REPRESENTATIVES We shall direct that the questions concerning representation which have arisen be resolved by separate elections by secret ballot among the employees in the appropriate units who were employed during the pay- roll period immediately preceding 'the date of our Direction of Elec- tions herein, subject to the limitations and additions set forth therein. DIRECTION OF ELECTIONS By virtue of and pursuant to the power vested in the National Labor ,Relations-Board by Section 9' (c) of the National Labor Relations Act, and pursuant to Article III, Section 9, of National Labor Relations Board Rules and 'Regulations-Series 3, it is hereby DIRECTED that, as part of the investigation to ascertain representa- tives for the purposes of collective bargaining with Standard Oil Com- pany of. New Jersey (Bayonne Refinery), Bayonne, New Jersey, separate, elections by secret ballot shall be conducted as early as possi- ble,but not later than thirty ,(30), days from the date of this Direction, under the direction and, supervision of _-the Regional Director for the ,Second Region, acting in this matter-as agent for the,National Labor Relations Board, and subject to Article III, Sections 10 and-11, of said, Rules and Regulations, among the employees in the units found appro- priate in Section IV, above, who were employed during the. pay-roll period immediately preceding the date, of this Direction, including employees who did not work,during said payroll, period, because 4hey were'ill or on vacation or temporarilylaid off, and including employees in the armed forces of the United States who present themselves in ,person at the polls, but excluding any who have since, quit or been ,discharged for cause and,-have not been rehired or reinstated prior to -the date of the elections, to, determine in each instance whether or not they desire to be represented by,'Standard' Refinery Union; Inc., for the purposes,of collective bargaining. 4 The parties stipulated that the classification "executives" refers to all persons listed in paragraph No. 2 of Appendix A.
