The Direction of Election provided that an election by secret ballot be conducted within fifteen (15) days from the date of the Direction among the production and mainte- nance employees of Sloss-Sheffield Steel &. Iron Company at its red- ore mine, Sloss, Alabama, who were employed by the Company during the pay-roll period immediately preceding August 29, 1939, including employees who did not work during such pay-roll period because they Were ill or on vacation and employees who were then or_ had since been temporarily laid off, but excluding clerical, super- visory, and commissary employees and those who, had since quit or been discharged for cause, to determine whether or not they desire' to be represented for the purposes of collective bargaining by Sloss Red Ore Local 109, international Union of Mine, Mill and Smelter Workers. Pursuant to the Direction of Election, an election by secret ballot was conducted on September 12, 1939, at Bessemer, Alabama, under the direction and supervision of the Regional Director for the Tenth Region (Atlanta, Georgia). On September 15, 1939, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, issued and duly served upon the parties his Election Report.
