Remington Rand, Inc.Download PDFNational Labor Relations Board - Board DecisionsJun 29, 194350 N.L.R.B. 979 (N.L.R.B. 1943) Copy Citation In the Matter of REMINGTON RAND, INC-. and INTERNATIONAL Asso- CIATION OF MACHINISTS, LOCAL 826 Case No. R-3703 SUPPLEMENTAL DECISION ' Decided June 29, 1943 On April 30, 1942, the National Labor Relations Board issued a Decision and Direction of Election in the above-entitled proceeding., On May 9, 1942, the Board issued an Amendment to the Direction of Election.2 On Julie 8, 1942, the Board issued a Supplemental Decision and Certification of Representatives,' certifying Local 826, International' Association of Ma6hinists,4 herein called the I. -A. M., as the exclusive representative for the purposes of collective bar- gaining of all production and maintenance employees at the Elmira plant of Remington Rand, Inc. (herein called the Company), in- cluding janitors and stockroom helpers, stock chasers, steel workers, weight clerks, layout men, and posting and dating-out clerks, all in Department 70; but excluding time-study men, watchmen, and office, clerical, and supervisory employees. Thereafter, on May, 11, the I. A. M. filed a motion for a supple- mental order interpreting the said Certification of Representatives as applying to all such included' production and maintenance, em- ployees at the Elmira plant of the Company including those em- ployed in the now so-called "E" and "N" Divisions of the said Elmira plant. Pursuant to an order of the Board, dated May 18, 1943, the 'record in the above-entitled case was reopened, and a. hear- ing upon. due notice was held at Elmira, .Nev York, o'n,June 8, 1943, before Francis V. Cole, Trial Examiner., The Company and the I. A.. M. appeared and participated.' F, At the hearing the Company and the I. A. ' At the time of the certification and prior thereto the I. A. M. was affiliated with the American Federation of Labor as is recited in said certification. The I. A. M withdrew its affiliation from the American•Federation of Labovas of May 31, 1943. 6 Notice of said hearing was also served upon the United Electrical, Radio and Machine- Workers, of America, which was originally a party to this proceeding but which had with- drawn from the ballot in the election held May 20, 1942. B., No. 140. 979, 980 / IYECISIONbS OF NATIONAL LABOR RELATIONS BOARD proceeding, the Company had been engaged in negotiations with the United States Government for the erection by the latter of an addition to the Company's Elmira plant to be used for the purpose of manufacturing war items; that thereafter such addition to the original plant was constructed adjacent to and connected with the original plant and that operations therein were commenced subsequent to the Supplemental Decision and Certification of Representatives referred to above; that a substantal number of the officials, executives, and supervisory employees, and a majority of the production and mainte- nance employees in the new addition to the plant were transferred from the original plant to the new addition or laid off at the original plant and rehired at the new addition; that the Company has desig- nated the original plant as Division "E," and the new addition as Division "N"; and that the Company is the sole employer of the em- ployees employed in said Division "E" and said Division "N." On the basis of said stipulated facts the parties stipulated and agreed that the unit set forth in the Supplemental Decision and Certification of Representatives issued by the Board on June 8, 1942, did and does now consist of employees in the Elmira plant of the Company including the employees in the now so-called "E" Division and "N" Division, but did not and does not now include employees of Andover Motors Cor- poration which occupies leased space at said Elmira plant. The par- ties requested the Board to issue a 'statement clarifying such unit description in the form set forth below. In accordance with the said stipulation between the Company and the I. A. M., we hereby find that the unit described in the said Sup- plemental Decision and Certification of Representatives,. dated June 8, 1942, should, and may deemed amended to read as follows: "All' production-and`mainteii'anceemployees' employed by Reming- ton-Rand, Inc., at its Elmira plant, specifically including the produc- tion and maintenance employees at the "E" and "N" Divisions of said plant; and specifically including janitors and stockroom helpers, stock chasers, steel workers, weight clerks, layout men, posting and dating-out clerks, but excluding time-study men, watchmen, and office, clerical, and supervisory employees."
