Request No. 2022002974 Appeal No. 2019001705 Agency No. 4F-945-0125-18 DECISION ON REQUEST FOR RECONSIDERATION Complainant requested that the Equal Employment Opportunity Commission (EEOC or Commission) reconsider its decision in Delbert S. v. U.S. Postal Serv., EEOC Appeal No. 2019001705 (Mar. 21, 2019). EEOC Regulation 29 C.F.R. § 1614.405(c) provides that a request for reconsideration to the Commission must be filed within 30 calendar days after a complainant receives the appellate decision. The appellate decision included a Certificate of Mailing indicating that for timeliness purposes, the Commission will presume that the decision was received within five calendar days after it was provided to Complainant, via U.S. Mail, which would have been no later than March 26, 2019. Complainant filed the instant request on May 5, 2022, over three years later. In his request, Complainant does not provide any persuasive justification for extending the filing period beyond 30 days. Accordingly, the request is DISMISSED as untimely filed pursuant to § 1614.405(c). The decision in EEOC Appeal No. 2019001705 remains the Commission's decision.
