JUDGMENT Granting Request for Adverse Judgment After Institution of Trial 37 C.F.R. § 42.73(b) IPR2020-00060 Patent 8,852,490 B2 2 Forterra Pipe & Precast, LLC (“Petitioner”) filed a Petition (Paper 1, “Pet.”) requesting an inter partes review of claims 1–8 of U.S. Patent No. 8,852,490 B2 (Ex. 1001, “the ’490 Patent”). On April 22, 2020, we instituted trial on all challenged claims. Paper 13, 34. On October 19, 2020, PF3 Global, LLC (“Patent Owner”) filed a Consent to an Adverse Judgment (Paper 17), which states “Patent Owner has agreed to confirm that it is abandoning this contest and consents to adverse judgment under 37 C.F.R. § 42.73(b)(4).” Paper 17, 2. This paper thus constitutes a request for adverse judgment under 37 C.F.R. § 42.73(b)(4), which Patent Owner indicates Petitioner does not oppose. Id. Having reviewed Patent Owner's request for adverse judgment, we grant the request for adverse judgment pursuant to 37 C.F.R. § 42.73(b)(4). ORDER It is: ORDERED that Patent Owner’s request for adverse judgment is granted, and judgment is entered against Patent Owner; FURTHER ORDERED that claims 1–8 of the ’490 patent are canceled.
