Mar. 2, 2015) Copy Citation Atlanta, Georgia UNITED STATES OF AMERICA BEFORE THE NATIONAL LABOR RELATIONS BOARD NEWTON WELDING SERVICES Employer and INTERNATIONAL ASSOCIATION OF BRIDGE, STRUCTURAL, ORNAMENTAL AND REINFORCING IRON WORKERS Petitioner Case 10-RC-123108 DECISION AND CERTIFICATION OF RESULTS OF ELECTION The National Labor Relations Board has considered challenged ballots in a mail-ballot election held between December 1, 2014 and January 15, 2015, and the Regional Director's report recommending disposition of them. The election was conducted pursuant to a Stipulated Election Agreement. The tally of ballots shows 2 ballots cast for the Petitioner and 3 ballots cast against the participating labor organization, with 2 challenged ballots, a sufficient number to affect the results. No exceptions have been filed to the Regional Director's report within the time provided. Accordingly, the Board adopts the Regional Director's findings and recommendations, and finds that a certification of results of election should be issued.1 1 The Regional Director recommended that the challenges to the Board agent’s determination to void the ballots cast by Jose Negrete and Victor Alonso Campos be overruled and that their ballots shall remain unopened and uncounted. 2 CERTIFICATION OF RESULTS OF ELECTION IT IS CERTIFIED that a majority of the valid ballots have not been cast for International Association of Bridge, Structural, Ornamental and Reinforcing Iron Workers, and that it is not the exclusive collective-bargaining representative of these bargaining unit employees.
