The Direction of Election provided that an election by secret ballot be conducted within fifteen (15) days from the date of the Direction among the production employees of May Manufacturing Company, Inc. at its New York City plant, who were employed as of October 1, 1938, excluding shipping clerks, foremen, office help, salesmen, and those employees who had since quit or been discharged for cause, to determine whether or not they desired to be represented by United Optical Workers Union, Local No. 208, affiliated with the Committee for Industrial Organization, for the purposes of collective bargaining. Pursuant to the Direction of Election, an election by secret ballot was conducted on February 6, 1939, under the direction and super- vision of the Regional Director for the Second Region (New York City). Full opportunity was afforded all parties to this investigation to participate in the conduct of the secret ballot and to make chal- lenges. On February 8, 1939, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 1, as amended, issued an Intermediate Re- port on the election, copies of which were duly served upon the par- ties. No objections or exceptions to the Intermediate Report have been filed by any of the parties. (a) of the Act, United Op- tical Workers Union, Local No. 208, affiliated with the Committee.for Industrial Organization, is the exclusive representative of all such employees for the purposes of collective bargaining in respect to rates of pay, wages, hours of employment, and other conditions of employment.
