DECISION ON APPEAL1 Pursuant to 35 U.S.C. § 134(a), Appellant2 appeals from the Examiner’s decision to reject claims 1, 7, 9–12, 15–18, 21, and 23. We have jurisdiction under 35 U.S.C. § 6(b). Appeal 2020-000009 Application 14/326,590 2 STATEMENT OF THE CASE The subject matter on appeal relates to a mixed cathode active material having improved power characteristics and a lithium secondary battery including the same. Spec. ¶ 1. The mixed cathode active material is described as using LiFePO4 (LFP) having a portion of iron (Fe) substituted with other elements, such as manganese (Mn), to prevent a rapid voltage drop in the transient region when layered-structure lithium transition metal oxide and olivine-structure lithium oxide (e.g. LFP) are blended. Id. Claim 1 is illustrative and reproduced from the Claims Appendix to the Appeal Brief. 1.
