Request No. 2020000960 Appeal No. 2018000047 Agency No. CSOSA-EEO-F-17-0039 DECISION ON REQUEST FOR RECONSIDERATION Complainant requested that the Equal Employment Opportunity Commission (EEOC or Commission) reconsider its decision in EEOC Appeal No. 2018000047 (October 11, 2019). EEOC Regulations provide that the Commission may, in its discretion, grant a request to reconsider any previous Commission decision issued pursuant to 29 C.F.R. § 1614.405(a), where the requesting party demonstrates that: (1) the appellate decision involved a clearly erroneous interpretation of material fact or law; or (2) the appellate decision will have a substantial impact on the policies, practices, or operations of the agency. See 29 C.F.R. § 1614.405(c). In her underlying complaint, Complainant alleged that the Agency subjected her to unlawful reprisal discrimination when: (1) on or about August 10, 2017, management lowered her overall performance rating from a level 4 to a level 3 score; and (2) on an unspecified date, her request to participate in the Department of Homeland Security/Federal Emergency Management Agency surge capacity force was denied.2 Following an investigation, the Agency issued a final decision finding no discrimination. On appeal, the Commission affirmed the Agency’s final decision. 1 This case has been randomly assigned a pseudonym which will replace Complainant’s name when the decision is published to non-parties and the Commission’s website. 2 In her formal complaint, Complainant also alleged that the hearing examination job duties she had been performing, which were GW-14 level duties but were never added to her position description, were reassigned to her first line supervisor. Complainant, however, withdrew this claim during the investigation, therefore it was not addressed on appeal. 2020000960 2 Specifically, we found that assuming, arguendo, Complainant established a prima facie case of reprisal, the Agency nonetheless articulated legitimate, nondiscriminatory reasons for its actions that Complainant failed to show were pretextual. In her request for reconsideration, Complainant largely reiterates arguments made below, and fully considered on appeal. The Commission emphasizes that a request for reconsideration is not a second appeal to the Commission. Equal Employment Opportunity Management Directive for 29 C.F.R. Part 1614 (EEO MD-110), at 9-18 (Aug. 5, 2015); see, e.g., Lopez v. Dep't of Agric., EEOC Request No. 0520070736 (Aug. 20, 2007). Rather, a reconsideration request is an opportunity to demonstrate that the appellate decision involved a clearly erroneous interpretation of material fact or law, or will have a substantial impact on the policies, practices, or operations of the Agency. Complainant has not done so here. Accordingly, after reviewing the previous decision and the entire record, the Commission finds that the request fails to meet the criteria of 29 C.F.R. § 1614.405(c), and it is the decision of the Commission to deny the request. The decision in EEOC Appeal No. 2018000047 remains the Commission's decision. There is no further right of administrative appeal on the decision of the Commission on this request. Thereafter, the Agency issued a final decision dismissing Complainant’s complaint. On appeal, the Commission affirmed the Agency’s final decision. The Commission found harassment is actionable if it is sufficiently severe or pervasive to alter the conditions of Complainant's employment. We found her claims were properly dismissed because assuming she could prove all her allegations, these actions would not rise to the level, even considered together, of a violation of the anti-discrimination statutes.
