Case No. 13-RC- 3564. June 30, 1954 SUPPLEMENTAL DECISION AND CERTIFICATION OF REPRESENTATIVES Pursuant to a Decision and Direction of Election issued here- in on March 11, 1954,1 an election by secret ballot was con- ducted on April 6, 1954 , under the direction and supervision of the Regional Director for the Thirteenth Region, among the employees in the unit found appropriate by the Board. Upon the conclusion of the election a tally of ballots was furnished the parties. The tally shows that of approximately 289 eligible voters , 219 cast ballots , of which 74 were for the Petitioner, 139 were for the Intervenor ,' 4 were against both participating labor organizations , and 2 were challenged. On April 13, 1954, the Petitioner filed objections to the election . The Regional Director investigated the objections, and on May 19, 1954, issued and duly served upon the parties his report on objections , in which he found that none of the Peti- tioner's objections raised substantial and material issues with respect to the election and recommended that they be over- ruled and the Intervenor certified as bargaining representative. Thereafter , the Petitioner filed timely exceptions to the Regional Director ' s report. The Board has considered the Petitioner ' s objections, the Regional Director ' s report on objections , the Petitioner's ex- ceptions to the report , and the entire record in the case. In accordance with the conclusion of the Regional Director and for the reasons stated in his report , the Board finds that the Petitioner ' s objections do not raise substantial and material issues with respect to the election . Accordingly, they are hereby overruled. As a majority of the ballots were cast for the Intervenor, we shall certify it as the representative of the employees in the appropriate unit. [The Board certified Allied Independent Unions, CUA, as the designated collective -bargaining representative of all em- ployees of the Employer employed at its stores in Milwaukee County, Wisconsin , excluding meat department employees, managers, assistant managers, casual part-time employees working less than 15 hours per week, professional employees, and supervisors as defined in the Act.] Member Rodgers took no part in the consideration of the above Supplemental Decision and Certification of Representa- tives. 1107 NLRB 1544. 2 Allied Independent Unions, CUA. 108 NLRB No. 231.
