DECISION AND ORDER STATEMENT OF THE CASE On September 14, 1937, Amalgamated Association of Iron, Steel and Tin Workers of North America, Lodge 1762, herein called the Amalgamated, filed with the Regional Director for the Thirteenth Region (Chicago, Illinois) a petition 1 alleging that a question affect- ing commerce had arisen concerning the representation of employees of Joilet Wrought Washer Company, Rockdale, Illinois, herein called the respondent, and requesting an investigation and certification of representatives pursuant to Section 9 (c) of the National Labor Re- lations Act, 49 Stat. 449, herein called the Act. On October 2, 1937, the Amalgamated filed a charge with the Regional Director, alleging that the respondent had engaged in and was engaging in unfair 'In this petition the Amalgamated is designated as "New Act Lodge 1672." On November 2, 1937, the National Labor Relations Board, herein called the Board, acting pursuant to Section 9 (c) of the Act and Article III, Section 3, of National Labor Relations Board Rules and Regulations-Series 1, as amended, ordered an investigation of the questions raised in the petition and authorized the Regional Director to conduct such investigation and to provide for an appropriate hearing upon due notice. At the same time, acting pursuant to Article III, Section 10 (c), (2), and Article II, Section 37 (b), of said Rules and Regu- lations, the Board ordered that the cases arising from the petition and the charge be consolidated for the purpose of hearing. There- after the Amalgamated, acting by and through Steel Workers Or- ganizing Committee, affiliated with the Committee for Industrial Organization, herein called the S. W. O. C., filed with the Regional Director an amended petition for investigation and certification of representatives, dated March- 31, 1938, and amended charges, dated October 30, 1937, and March 31, 1938, alleging that the respondent had engaged in and was engaging in unfair labor practices affecting commerce, within the meaning of Section 8 (1), (3), and- (5) and Section 2 (6) and (7) of the Act. Upon the charge and amended charges duly filed by the Amal- gamated, acting by and through the S. W. O. C., the Board, by the Regional Director, issued its complaint dated March 31, 1938, against the respondent, alleging that the respondent had engaged in and was engaging in unfair labor practices affecting commerce, within the meaning of Section 8 (1), (3), and (5) and Section 2 (6) and (7) of the Act. Copies of the complaint and an accompanying. notice of hearing were duly served upon the respondent, the S. W. O. C., and the president of the Central Trades and Labor Council, of Joliet, Illinois, affiliated with the American Federation of Labor. With respect to the unfair labor practices, the complaint alleged in substance: (1) that on May 17 and 19, 1937, and thereafter, the respondent had refused to bargain collectively with the Amalgamated as the exclusive representative of employees in a unit composed of production and maintenance workers and machinists, exclusive of supervisory, office and clerical employees, and watchmen; (2) that it discharged an employee on June 4, 1937, for the reason that he had joined and assisted the Amalgamated; (3) that it locked out 44 named employees on June 7, 1937, for the reason that such employees had joined the Amalgamated and refused to join Wrought Washer Workers Union, No. 20709,2 herein called Local 20709; (4) that it 2 Designated in the complaint as wrought washer Federal Union Local #20709. 1098 DECISIONS OF NATIONAL LABOR RELATIONS BOARD had instigated the formation of Local 20709 on May 13, 1937, and had thereafter urged and warned its employees to join Local 20709 and had otherwise fostered, promoted, and encouraged its growth and dominated and interfered with its administration; and (5) that the respondent had entered into an agreement with Local 20709 on May 14, 1937, recognizing it as the sole bargaining agency for all em- ployees in the respondent's plant and requiring newly hired employees to become members of Local 20709. On April 5, 1938, the respondent filed its answer in which it denied the commission of unfair labor practices as alleged in the complaint Pursuant to notice, a hearing .was held at Joliet, Illinois, from April 7 to 13, 1938, before Charles W. Whittemore, the Trial Exam- iner duly designated by the Board. The Board, the respondent, and the S. W. O. C. were represented by counsel or other duly authorized agent and participated in the hearing. Full opportunity to be heard, to examine and cross-examine witnesses, and to introduce evidence bearing on the issues was afforded all parties. The Trial Examiner filed an Intermediate Report, dated May 9, 1938, copies of which were duly served upon the respondent and the S. W. O: C. He found that the respondent had engaged in and was engaging in unfair labor practices affecting commerce, within the meaning of Section 8 (1), (3), and '(5) and Section 2 (6) and (7) of the Act. He recommended that the respondent cease and desist from such unfair labor practices, that it reinstate 41 employees with back pay, and that, upon request, it bargain collectively with the Amalgamated as the exclusive representative of its production and maintenance employees, with the exception of watchmen and super- visory employees. On May 23, 1938, pursuant to an extension of time duly granted, the respondent filed its exceptions to the Intermediate Report. On May 21, 1938, International Association of Machinists, herein called the Machinists, filed a petition for leave to file exceptions to the Intermediate Report. On May 23, 1938, a similar petition was filed by Local 20709. Pursuant to permission granted by the Board, exceptions to the Intermediate Report were duly filed on May 31, 1938, by the Machinists and Local 20709. On June 9, 1938, a stipulation and agreement, settling the issues of the entire proceeding, was entered into by the respondent; the Amal- gamated, acting by and through the S. W. O. C.; and the Regional Director. The stipulation and agreement provides as follows: I The respondent is, and has been since November 7, 1914, a corporation' organized and existing by virtue of the laws of the JOLIET WROUGHT WASHER COMPANY 1099 State of Illinois, having its office, and manufacturing plant in the City of Rockdale, Will County, State of Illinois, and is now and has continuously engaged at said plant in the production, sale and distribution of steel washers and stampings. The chief raw material used by the respondent in the course and conduct of its business, consists solely of scrap steel. During the period from July 1, 1937 to December 31, 1937, the respondent purchased and had shipped to its plant from points within the State of Illinois a total of 775,733 pounds of scrap steel. During the same period the respondent purchased and had shipped to its plant from points outside the State of Illinois a total of 6,903,660 pounds of scrap steel. Sales and distribution of respondent's washers and stampings within the State of Illinois during the same period were valued at $47,883.58. The value of the same products sold and shipped into states other than the State of Illinois during the same period was $75,710.45. The respondent's plant is served by a spur track of the Chi- cago, Rock Island and Pacific Railroad. Steel shipments to the plant are mainly in carload lots, a small portion arriving by truck. Unloading and loading of raw materials and finished products from cars and trucks are performed-by the respondent's employees. The respondent is engaged in interstate commerce within the meaning of Section 2 (6) and (7) of the National Labor Rela- tions Act, 49 Stat. 449, hereinafter called the Act. II It is further stipulated and agreed by and between the re- spondent, the union, and Leonard C. Bajork, Regional Director for the Thirteenth Region, National Labor Relations Board, that upon the basis of the record and Trial Examiner's Inter- n diate Report in the above captioned case, and this stipulation, if approved by the National Labor Relations Board, hereinafter called the Board, and which stipulation is subject to the Board's consideration of the exceptions filed with the Board on May 31, 1938, by Wrought Washer Federal Union Local 20709 and the International Association of Machinists, both labor organiza- tions affiliated with the American Federation of Labor, to the Trial Examiner's Intermediate Report, an order may forthwith be entered by the Board providing as follows : 1. The respondent, Joliet Wrought Washer Company, and its officers, agents, successors and assignees, shall: (a) Cease and desist from : (1) In any manner interfering with, restraining or coercing its employees in the exercise of their right to self-organization, 1100 DECISIONS OF NATIONAL LABOR RELATIONS BOARD to form, join, or assist labor organizations, to bargain collec- tively through representatives of their own choosing, and to engage in concerted activities for the purpose of collective bar- gaining or other mutual aid or protection, as guaranteed in Section 7 of the Act. (2) Refusing to bargain collectively with the Amalgamated Association of Iron, Steel and Tin Workers of North America, Lodge 1762, by and through Steel Workers Organizing Com- mittee, affiliated with the Committee for Industrial Organization, as exclusive representative of all its production and maintenance employees and machinists; excluding supervisory, office and clerical employees, and watchmen. (3) Discouraging membership in the Amalgamated Associa- tion of Iron, Steel and Tin Workers of North America, Lodge 1762, by and through Steel Workers Organizing Committee, affiliated with the Committee for Industrial Organization, or any other labor organization of its employees, or encouraging mem- bership in the Wrought Washer Federal Union, Local 20709, by discriminating in regard to hire or tenure of employment, or any term or condition of employment, or by threats of such discrimination. (4) Conditioning employment in the respondent's plant upon membership in the Wrought Washer. Federal Union, Local 20709; (5) Giving effect to its agreements with the Wrought Washer Federal Union, Local 20709, purportedly signed on May 28 and 29, 1937. 2. If after reinstating. the afore-mentioned employees and dis- missing employees hired since June 7, 1937, the respondent de- termines that the services of its staff are not required for the operation of its plant, it may reduce its staff, providing the reduction is made without discrimination against any employees because of union affiliation or activities, following a system of seniority to be agreed upon with the Amalgamated Association of Iron, Steel and Tin Workers of North America, Lodge 1762, by and through Steel Workers Organizing Committee, affiliated with the Committee for Industrial Organization; (b) Within a week after the Board's approval of this stipu- lation pay back pay, by check, to the following employees the amounts set forth after their names : Walter Toton, $30.00 Warry DiGiusto, $30.00 Lester Cooney, $30.00 John Midlock, Jr., $30.00 (c) Pay back pay to the employees named in Appendix "A", attached hereto and made a part hereof, in the amount of five thousand dollars ($5,000.00) in accordance with the following schedule and terms of payment. . Within a week after the Board's approval of this stipulation, the respondent agrees to pay part of the back pay due the em- ployees named in Appendix "A" in the amount of twenty-four hundred dollars ($2,400.00), to be divided equally among each of said employees, respectively, by payment to each of them, re- spectively, by check, the sum of sixty-three dollars and fifteen cents ($63.15). Thirty (30) days after the Board's approval of this stipulation, the respondent agrees to pay the balance of the back pay due the employees named in Appendix "A" in the amount of twenty-six hundred dollars ($2,600.00), to be divided equally among each of said employees, respectively, by payment to each of them, respectively, by check, not less than five dollars ($5.00) per month until each of them respectively shall have re- ceived his equal share, namely the sum of sixty-eight dollars and 1102 DECISIONS OF NATIONAL LABOR RELATIONS BOARD forty-two cents ($68.42). In addition to the above sums the re- spondent agrees to pay for each of the employees named in Ap- pendix "A", respectively, his share of Social Security taxes. Such taxes are not to be deducted from the above sums. If any of the employees named in Appendix "B" attached hereto and made a part hereof are laid off, quit, or discharged for a period of more than thirty (30) consecutive days, the respondent agrees to pay, upon demand, to each of said employees so laid off, quit, or discharged, twenty-nine dollars and forty-one cents ($29.41) ; (d) Upon request, bargain collectively with Amalgamated Association of Iron, Steel and Tin Workers of North America, Lodge 1762, by and through Steel Workers Organizing Com- mittee, affiliated with the Committee for Industrial Organiza- tion, as the exclusive representative of all its production and maintenance employees and machinists, excluding supervisory, office and clerical employees, and watchmen, in respect to rates of pay, wages, hours of employment, and other conditions of employment. (e) Post immediately in conspicuous places throughout all departments of its plant in the City of Rockdale, Will County, State of Illinois, and maintain for a period of thirty (30) con- secutive days from the date of posting, notices to its employees stating : (1) that the respondent will cease and desist in the manner aforesaid ; (2) that the respondent's employees, in order to secure or continue their employment, need not become or remain mem- bers of the Wrought Washer Federal Union, Local 20709; (3) that,the respondent's agreements with the Wrought Washer Federal Union, Local 20709, signed on May 28 and May 29, 1937, are null, void, and of no effect ; (4) that the respondent upon request, will bargain collectively with Amalgamated Association of Iron, Steel and Tin Workers of North America, Lodge 1762, by and through Steel Workers Organizing Committee, affiliated with the Committee for Indus- trial Organization, as the exclusive representative of all its production and maintenance employees and machinists, exclud- ing supervisory, office and clerical employees, and watchmen, in respect to rates of pay, wages, hours of employment, and other conditions of employment; (5) that the respondent will not discharge, or in any manner discriminate in regard to hire or tenure of employment, or any term or condition of employment of members of the Amalga- mated Association of Iron, Steel, and Tin Workers of North JOLIET WROUGHT WASHER COMPANY 1103 America, Lodge 1762, by and through Steel Workers Organizing Committee, (affiliated with the Committee) s for Industrial Or- ganization, ' or any person assisting said organization, by reason of such membership or assistance ; (f) Notify the Regional Director for the Thirteenth Region in writing within ten (10) days from the date of the Board's order what steps the respondent has taken to comply herewith. Upon the Board's issuance of an order based upon terms and provisions of the stipulation as herein set out, the respondent expressly consents to the entry by the appropriate United States Circuit Court of Appeals of an enforcement order embodying the terms of the Board order, and waives further notice of the Board's application therefor. On June 16, 1938, the Board issued an order approving the stipu- lation and agreement and making it a part of the record in the case, subject, however, to the Board's consideration of the exceptions to the Trial Examiner's Intermediate Report filed by Local 20709 and the Machinists. In view of the stipulation and agreement it was unnecessary for the Board to consider the exceptions filed by the respondent. The Board has considered the petitions of Local 20709 and the Machinists for leave to file exceptions to the Intermediate Report of the Trial Examiner and the exceptions filed pursuant thereto. The petitions allege and the record establishes that neither of these two organiza- tions was served with a copy of the notice of hearing or otherwise made a party to the proceedings prior to the time when each filed its petition for leave to file exceptions. The petitions and exceptions show that substantial interests of both labor organizations in the representation of employees of the respondent and in contractual obligations would be adversely affected by an order incorporating in full the provisions of the stipulation and agreement as executed by the respondent, the Amalgamated, and the Regional Director. The stipulation and agreement was, however, made and approved sub- ject to the Board's consideration of the exceptions of Local 20709 and the Machinists. The Board will, therefore, confine ,its order to such provisions of the stipulation as do not involve rights of Local 20709 or the Machinists and will, in all other respects, dismiss the complaint and the petition filed by the Amalgamated.4 8 Added. S The Board has been informed by the Regional Director that the respondent has bar- gained with the Amalgamated since the signing of the stipulation and agreement and has executed a contract with that organization . Further proceedings in the instant cases are, therefore , unnecessary. 1104 DECISIONS OF NATIONAL LABOR RELATIONS BOARD Upon the basis of the above stipulation and the entire record in the case, the Board makes the following : FINDINGS OF FACT 1. THE BUSINESS OF THE RESPONDENT Joliet Wrought Washer Company is, and has been since November 7, 1914, a corporation organized and existing by virtue of the laws of the State of Illinois , having its office and manufacturing plant in the city of Rockdale , Will County, State of Illinois , and is now and has continuously engaged at said plant in the production, sale, and distribution of steel washers and stampings . We find that the aforesaid operations of the respondent constitute a continuous flow of trade , traffic, and commerce among the several States. II. THE ORGANIZATIONS INVOLVED Amalgamated Association of Iron, Steel and Tin Workers of North America, Lodge 1762, acting by and through Steel Workers Organizing Committee, is a labor organization affiliated with the Committee for Industrial Organization, admitting to its member- ship production and maintenance workers and machinists employed by the respondent, excluding watchmen, supervisors, and office and clerical employees. International Association of Machinists is a labor organization affiliated with the American Federation of Labor, admitting to its membership machinists employed by the respondent. Wrought Washer Workers Union No. 20709 is a labor organization affiliated with the American Federation of Labor. ORDER Upon the basis of the above findings of fact, stipulation, and the entire record in the case, and pursuant to Sections 9 (c) and 10 (c) of the National Labor Relations Act and Article. III, Section 8, of National Labor Relations Board Rules and Regulations-Series 2, the National Labor Relations Board hereby orders that Joliet Wrought Washer Company, its officers, agents, successors, and assigns, shall: 1. Cease and desist from : (a) In any manner interfering with, restraining, or coercing its employees in the exercise of their right to self-organization, to form, join, or assist labor organizations, to bargain collectively through representatives of their own choosing, and to engage in concerted activities for the purpose of -collective bargaining or other mutual aid or protection, as guaranteed in Section 7 of the Act; (b) Discouraging membership in the Amalgamated Association ,of Iron, Steel and Tin Workers of North America, Lodge 1762, by and through Steel Workers Organizing Committee, affiliated with the Committee for Industrial Organization,. or any other labor organiza -tion of its employees, by discriminating in regard to hire or tenure of employment, or any term or condition of employment, or by threats of such discrimination. . 2. If after rein- stating the afore-mentioned employees and dismissing employees hired since June 7, 1937, the respondent determines that the services of its staff are not required for the operation of its plant, it may reduce its staff, providing the reduction is made without discrimina- tion against any employees because of union affiliation or activities; (b) Pay back pay, by check, to the following employees in the amounts set forth after their names : . Walter Toton, $30.00 Warry DiGiusto, $30.00 Lester Cooney, $30.00 John Midlock, Jr., $30.00 (c) Pay back pay to the employees named in Appendix "A," attached hereto and, made a part hereof, in the amount of fivd thou- sand dollars ($5,000.00) in accordance with the following schedule and terms of payment. Pay part of the back pay due the employees named in Appendix "A" in the amount of twenty-four hundred dollars ($2,400.00), to be divided equally among each of said employees, respectively, by payment to each of them, respectively, by check, the sum of sixty- three dollars and fifteen cents ($63.15). If any of the employees named in Appendix "B" attached hereto and made a part hereof are laid off, quit, or discharged for a period of more than thirty (30) consecutive days, pay, upon demand, to each of said employees so laid off, quit, or discharged, twenty-nine dollars and forty-one cents ($29.41) ; (d) Post immediately in conspicuous places throughout all depart- ments of its plant in the city of Rockdale, Will County, State ot Illinois, and maintain for a period of thirty (30) consecutive days from the date of posting, notices to its employees stating : (1) That the respondent will cease and desist in the manner afore- said ; (2) That the respondent will not discharge, or in any manner dis- criminate in regard to hire or tenure of employment, or any term or condition of employment of members of the Amalgamated As- sociation of Iron, Steel and Tin Workers of North America, Lodge 1762, by and through Steel Workers Organizing Committee, affiliated JOLIET WROUGHT WASHER COMPANY 1107 with the Committee for Industrial Organization, or any person assist- ing said organization, by reason of such membership or assistance; (e) Notify the Regional Director for the Thirteenth Region (Chicago, Illinois) in writing within ten (10) days from the date of the Board's Order what steps the respondent has taken to comply herewith. IT IS FURTHER ORDERED that the complaint be, and it hereby is, dis- missed in so far as it alleges that the respondent engaged in unfair labor practices by refusing to bargain collectively with the Amalga- mated ; fostering, promoting, and encouraging the growth of Local 20709 and dominating and interfering with its administration; or entering into a contract with Local 20709. AND IT IS FURTHER ORDERED that the amended petition for investi- gation and certification of representatives of employees of Joliet Wrought Washer Company, Rockdale, Illinois, filed by Amalgamated Association of Iron, Steel and Tin Workers of North America, Lodge 1762, by and through Steel Workers Organizing Committee, affiliated with the Committee for Industrial Organization, be, and it hereby is, dismissed.
