The Direction of Election provided that an election by secret ballot be conducted within fifteen (15) days from the date of the Direction among the production and mainte- nance employees of Johnson-Carper Furniture Company, Inc., Roan- oke, Virginia, herein called the Company, whose names appeared on the Company's July 1, 1939, pay roll, including employees who did not work during such pay-roll period because they were ill or on vaca- tion, and employees who were then or had since been temporarily, laid. off, but excluding employees who had since quit or had been dis- charged for cause, to determine whether or not they desired to be represented by Local 283, United Furniture Workers of America, for the purposes of collective bargaining. Pursuant to the Direction, an election by secret ballot was con- ducted on August 31, 1939, at Roanoke, Virginia, under the direction and supervision of the Regional Director for the Fifth Region (Bal- timore, Maryland). On September 1, 1939, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Re- lations Board Rules and Regulations-Series 2, issued an Election Report, copies of which were duly served upon the parties. On September 27, 1939, the Regional Director issued his Report on Objections to Election Report, finding that the objec- tions were addressed to the eligibility provisions set forth in the Decision and Direction of Election; and that they raised no substan- tial and material issues which were not covered by the Decision. We have considered the Objections to the Election Report, together with the Regional Director's Report on Objections to Election Report, and find the objections to be without merit. We hereby overrule such objections. By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Rela- tions Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 2, IT IS HEREBY CERTIFIED that Local 283, United Furniture Workers of America, has been designated and selected by a majority of the production and maintenance employees of Johnson-Carper Furniture Company, Inc., Roanoke, Virginia, as their representative for the purposes of collective bargaining and that, pursuant to Section 9 (a) of the National Labor Relations Act, Local 283, United Furniture Workers of America, is the exclusive representative of all such em- ployees for the purposes of collective bargaining in respect to rates of pay, wages, hours of employment, and other conditions of employment.
