ORDER
The Respondent’s request for special permission to appeal from Administrative
Law Judge John T. Giannopoulos’s April 1, 2019 order is denied. The Respondent has
failed to demonstrate that the judge abused his discretion in issuing the protective order
sealing certain documents and preventing dissemination or disclosure of certain
information to the public. The judge acted to protect inadvertently disclosed, sensitive
information personal to the Charging Party. That information was irrelevant to the
underlying proceedings, and the Respondent had not challenged the sensitive nature of
the information or demonstrated a significant interest in disseminating it.1

1 Because we deny the request for special permission to appeal on the merits, we do
not pass on the General Counsel’s motion to strike the request on timeliness
grounds. Moreover, we have not considered the Respondent’s May 22, 2019 and May
24, 2019 supplemental filings. The May 22 filing did not present argument or evidence
that was unavailable to Respondent when it first filed its special appeal. The May 24
filing submitted evidence unavailable at the time the judge issued the protective order,
but did so only to prove an undisputed fact.
