The General Counsel’s request for special permission to appeal from
Administrative Law Judge Kenneth W. Chu’s October 24, 2014 ruling is denied.2 The
General Counsel failed to demonstrate that the judge abused his discretion in denying
the General Counsel’s Motion for Production and/or In Camera Review of Documents
Listed in Respondents Revised Third Privilege Log or that its arguments regarding the
Board’s attorney-client privilege analysis could not be presented to the Board on
exceptions, if necessary.

three-member panel. Member Emanuel is recused and took no part in consideration of
this case.
