We have entered a decision on ViaCyte’s Miscellaneous Motion 1 1
motions (Paper accompanying this judgment). Paper 65. As a result of our 2
decision granting ViaCyte’s Miscellaneous Motion 1, holding that the 3
parties are bound in this interference by the Board’s decision in Interference 4
105,734, it is appropriate to enter judgment against Geron. 5
It is: 6
ORDERED that judgment on the subject matter of Count 1, the 7
sole count in the interference, is entered against junior party Geron. 8
FURTHER ORDERED that claims 19-39 of Geron’s 9
Application 12/543,875, which claims correspond to Count 1 (Paper 1 at 3), 10
are FINALLY REFUSED, 35 U.S.C. § 135(a). 11
FURTHER ORDERED that if there is a settlement agreement, 12
attention is directed to 35 U.S.C. § 135(c). 13
FURTHER ORDERED that a copy of this JUDGMENT shall 14
be placed in the files of (1) U.S. Patent 7,510,876 B2, and (2) U.S. 15
Application 12/543,875. 16
