DECISION ON APPEAL This is an appeal under 35 U.S.C. § 134(a) involving claims directed to a titanium coating on a silicone surface. The Examiner rejects the claims as anticipated. We have jurisdiction under 35 U.S.C. § 6(b). We AFFIRM. 1 According to Appellants, the real party in interest is Metascape LLC. Appeal Br. 1. Appeal 2016-001854 Application 12/706,315 STATEMENT OF THE CASE Claims 1—5 and 7—10 are on appeal, and can be found in the Claims Appendix of the Appeal Brief. Claim 1 is representative of the claims on appeal, and reads as follows (emphasis added): 1. A nanoparticulate adherent hydrophobic ion plasma deposited 10-40 nm size particulate titanium coating on a smooth silicone surface wherein the coating is more resistant to cell adhesion compared to an uncoated smooth silicone surface and has at least an order of magnitude lower cell density than a nanoparticulate titanium surface coating on an ultra high molecular weight polyethylene (UHMWPE) or polytetrafluoroethylene (PTFE) surface. The following grounds of rejection are before us for review: Claims 1—5 and 7—10 are rejected under 35 U.S.C. § 102(a) as being anticipated by Ogawa.2 Claims 1—5 and 7—10 are rejected under 35 U.S.C. § 102(e) as being anticipated by Ogawa. Anticipation Since both of these rejections rely upon the teaching of Ogawa regarding the titanium coating on a silicone surface, the same issue is dispositive for both of these rejections, so we will consider the rejections together. The Examiner finds that Ogawa teaches medical implants that have a nanostructure surface. See Non-Final Act. 3. Ogawa teaches that the 2 Ogawa, W02006/102347 A2, published Sept. 28, 2006, claiming priority to US Provisional Application No. 60/664,243 having a filing date of Mar. 21,2005. 2 Appeal 2016-001854 Application 12/706,315 nanostructure can be applied by plasma spray and teaches titanium coatings and silicone substrates. See Non-Final Act. 3. The Examiner finds that “the device of Ogawa comprising a silicone substrate with a titanium surface would inherently resist adhesion of cells including those listed in instant claims 3-4 since it is exactly the same material as the instantly claimed invention.” Non-Final Act. 3^4. Appellants contend that “[n]o coated substrates are described [in Ogawa] that have titanium nanoparticulates deposited on and adhered to a smooth silicone surface.” Appeal Br. 3. Appellants contend that “Ogawa clearly teaches that any substrate surface must be microstructured before attempting to deposit a nanorough titanium coating.” Appeal Br. 4. Ogawa teaches that “[p]rior to the nano-structuring described above, the substrate is subject to surface treatment to generate a microstructure on the surface of the substrate. Such surface treatment can be any suitable chemical or physical treatment or treatments capable of creating a microstructure on the substrate surface.” Ogawa 9:11—14. We agree with Appellants that Ogawa teaches applying coatings onto previously microstructured surfaces. The question is, can a microstructured or nanostructured surface be considered smooth, in other words, what is encompassed by the term smooth? We begin with claim construction of the term “smooth,” giving the claims their broadest reasonable interpretation consistent with the Specification. In re Hyatt, 211 F.3d 1367, 1372 (Fed. Cir. 2000). The Examiner finds that the term “smooth is not defined the Specification.” [A] smooth silicone substrate is so generic that it could be 3 Appeal 2016-001854 Application 12/706,315 micro-structured, nanostructured, macrostructured, previously engineered, previously not engineered etc. The smoothness of the surface could be in the micro, macro, or nano level. One of ordinary skill in the art would recognize that both a nano roughened and a micro roughened surface can be smooth. The smoothness of the surface is relative. Ans. 7; see Non-Final Act. 9. Appellants contend that not only is the term “smooth” used in the Specification but also provides a description, citing to paragraphs 40 and 72 of the Specification for support. Appeal Br. 4. These cited paragraphs read as follows: Silicone sheets, bars and strips were purchased from McMaster- Carr (Aurora,, OH 44202-8087) as Material Type NSP certified silicone rubber bar sheets, bars or strips without backing, with a thickness of 114", temperature range of -75° F to +400° F, smooth finish meeting FDA and NSF, FDA compliant and NSF 51 certified, sold under part number 5827T34. Spec. 140 Smooth silicone substrates were purchased from McMaster-Carr (Aurora, OH). Tests 1-31 (Table 1) were conducted on titanium coated smooth silicone surfaces after 7 days incubation with GF and/or PLC cells. Test 32 is a control measuring change in cell adhesion on untreated smooth silicone surfaces after incubation for 7 days. Spec. 172. We agree with Appellants that theses paragraphs use the word “smooth,” however, nothing recited in these paragraphs provides any support to define how smoothness is measured or assessed. In other words, a recitation of the word without further details does not provide any limitation as to what is encompassed by this term. We have reviewed the cited passages and agree with the Examiner that these passages do not provide insight into what is encompassed by the 4 Appeal 2016-001854 Application 12/706,315 term “smooth.” The reference to the NSF 51 certification in paragraph 40 of the Specification at best tells us that the material is food grade silicone. Being food grade silicone, however, does not tell us about the surface structure. The same is true with reference to the silicone substrate purchased form McMaster-Carr, there are no additional details of that material disclosed in the record as well. Accordingly, finding no evidence in this record that the Examiner’s interpretation in light of the Specification is unreasonable, we agree with the Examiner that broadest reasonable interpretation of the term “smooth” would encompass microstructures and nanostructures that are so fine that they would be perceived as smooth. See Ans. 7. Based on our finding that the Examiner has reasonably interpreted “smooth” as encompassing microstructures and nanostructures, we agree with the Examiner’s factual findings and conclusion, as set out in the Non- Final Action and Answer which we adopt and incorporate herein by reference. We agree with the Examiner that Ogawa teaches applying titanium particles onto silicone substrates. In re Best, 562 F.2d 1252, 1255 (CCPA 1977) (where the claimed and prior art products are identical or substantially identical, or are produced by identical or substantially identical processes, the PTO can require an applicant to prove that the prior art products do not necessarily or inherently possess the characteristics of his claimed product). Appellants also contend that “one [of skill in the art] would not expect to achieve a nanorough adherent titanium coating on smooth silicone.” Appeal Br. 6. 5 Appeal 2016-001854 Application 12/706,315 We are not persuaded as Appellants do not provide a sufficient evidentiary basis that shows titanium coatings would not be expected to stick to smooth silicone surfaces, or that shows when titanium is coated onto a smooth silicone surface as opposed to a rough silicone surface, cells would be able to perceive the difference in these two structures. Appellants fail to identify any evidentiary basis on this record that rebuts the Examiner’s reasoning that microstructure or nanostructure surfaces would not be considered smooth.3,4 In re Geisler, 116 F.3d 1465, 1471 (Fed. Cir. 1997) (Argument of counsel cannot take the place of evidence). Appellants contend that “the titanium coating on silicone, but not on other polymer substrates, attracts significantly fewer cells when used on silicone implant surfaces, compared with titanium coatings on other substrate surfaces.” Appeal Br. 6. These arguments are also unpersuasive because the rejection is based on anticipation and not obviousness, so consideration of unexpected results are not considered. Even if such information would be applicable to the present rejection we note that there is no comparison to the closest prior art, a titanium coating on a micro structured silicone surface as taught in Ogawa. 3 Smooth: Having a surface free from irregularities, roughness, or projections; even; having a fine texture. See Ans. 7; see Non-Final Act. 9. For example, comparing by touch 60, 100, 400 grit sand paper and plain paper, one would perceive the 60 and 100 grit sandpaper to be rough while the 400 grit sand paper and regular paper would be perceived as smooth. 6 Appeal 2016-001854 Application 12/706,315 SUMMARY We affirm the anticipation rejections of claim 1 under 35 U.S.C. §§ 102(a) and (e) by Ogawa. Claims 2—5 and 7—10 were not separately argued and fall with claim 1. 37 C.F.R. § 41.37 (c)(l)(iv). No time period for taking any subsequent action in connection with this appeal may be extended under 37 C.F.R. § 1.136(a).
