DECISION ON APPEAL STATEMENT OF CASE Appellants seek review of the Examiner’s decision to reject claims 1– 25 under 35 U.S.C. § 103(a) as obvious over Imer 1 with Sampath. 2,3 We have jurisdiction under 35 U.S.C. §§ 6(b) and 134(a). 1 US 7,361,576 B2, patented Apr. 22, 2008. 2 US 7,498,182 B1, patented Mar. 3, 2009. 3 The Examiner has withdrawn the rejection under 35 U.S.C. § 102(e), or alternatively under 35 U.S.C. §103(a), over Imer alone. The claims are directed to an utlraviolet light emitting semiconductor chip (see, e.g., claim 1) and a method of making it (see, e.g., claim 14). The chip includes a buffer layer, an n-junction LED layer, a multiple quantum well LED layer, and a p-junction LED layer. Claim 1 is illustrative of the chip.
