DECISION ON APPEAL Appeal 2010-002881 Application 10/571,624 2 SUMMARY This is an appeal under 35 U.S.C. § 134(a) from the Examiner’s rejection of claims 1, 5, and 7. Claims 2-4 and 6 have been canceled. We have jurisdiction under 35 U.S.C. § 6(b). Claims 1 and 5 stand rejected under 35 U.S.C. § 103(a) as unpatentable over Chua (US 2004/0072106 A1; Apr. 15, 2004 (filed Oct. 11, 2002)) and Maeda (WO 03/021691 A1; Mar. 13, 2003) (corresponding US 2004/0104391 A1; June 3, 2004 was used as an English translation). Claim 7 stands rejected under 35 U.S.C. § 103(a) as unpatentable over Chua, Maeda, and Jüstel (US 6,084,250; July 4, 2000). We affirm. STATEMENT OF THE CASE Appellant’s invention relates to a white light emitting lighting system. Abstract. Representative claim 1, reproduced below, is illustrative of the claimed subject matter: 1.
