ORDER DISMISSING APPEAL
On October 7, 2009, Appellants filed a Notice of Appeal. On June 14,
2010, the Examiner’s Answer was mailed. The Examiner’s Answer contains
two new grounds of rejection. According to 37 CFR § 41.39(b), Appellants
have two months from the date of the examiner’s answer to respond by
requesting that prosecution be reopened or that the appeal be maintained, in
order to avoid dismissal of the appeal. The record reveals that Appellants
have failed to file a response to the new grounds of rejection.
Accordingly, the appeal in this application is dismissed.
The application is being returned to the Examiner for further action as
may be appropriate.
