On August 10, 2006, Appellant filed a Notice of Appeal. On October
28, 2009, a merits panel of the Board of Patent Appeals and Interferences
affirmed the rejections of the examiner on claims 1-21 on appeal. On
December 28, 2009, Appellant filed a Request for Rehearing. On February
24, 2010, Appellant filed a request for Express Abandonment under 37 CFR
1.138.
Accordingly, it is ORDERED that: 1) no decision on the request for
rehearing will be rendered, and 2) the application will be returned to the
Examiner for further action as may be appropriate.
