Sep. 17, 2019) Copy Citation UNITED STATES OF AMERICA BEFORE THE NATIONAL LABOR RELATIONS BOARD DEEP DISTRIBUTORS OF GREATER NY d/b/a THE IMPERIAL SALES, INC. and Cases 29-CA-147909 29-CA-157108 LOCAL 660, UNITED WORKERS OF AMERICA and HENRY HERNANDEZ ORDER TRANSFERRING PROCEEDING TO THE BOARD and NOTICE TO SHOW CAUSE On August 26, 2019, the General Counsel filed with the National Labor Relations Board a motion for partial summary judgment on the grounds that the Respondent’s answer to sections I, II, and III of the compliance specification fails to satisfy the requirements of Section 102.56(b) of the Board’s Rules and Regulations, because the Respondent (1) provides only general denials of the allegations, without specifying the basis for its disagreement, and (2) offers no alternative facts, presumptions, or calculations, even though that information is within the Respondent’s knowledge. Having duly considered the matter, IT IS ORDERED that the above-entitled proceeding be transferred to and continued before the Board in Washington, D.C., and the hearing scheduled for September 24, 2019 be postponed indefinitely. NOTICE IS GIVEN that any party seeking to show cause why the General Counsel’s motion should not be granted must do so in writing, filed with the Board in Washington, D.C., on or before October 1, 2019 (with affidavit of service on the parties to this proceeding). If a response to this Notice to Show Cause is filed, a party may file a reply to the response within 7 days of receipt of the response (with affidavit of service on the parties to this proceeding), 2 but further responses will not be permitted except where there are special circumstances warranting leave to file such a response.
