D. Obenberger, and it respectfully moves for an extension of time in which to file Applicant’s Brief with the Board under the provisions of TBMP Section 1203.02 (d), and in support whereof, it states as follows: 1. The Board’s order setting the date upon which the Applicant’s Brief is due was mailed on December 15; Accordingly, the Brief is due for filing on February 13, 2009. 2. The Applicant has not previously sought an extension of time for the filing of a Brief in this matter. 3. The Applicant has good and meritorious grounds for extension of time. The Applicant’s attorney has been consumed with competing demands upon his time in other cases and in regard to other clients which has prevented the preparation of the Brief to this point in time. From February 4 until February 7, the undersigned attorney will attend mandatory continuing legal education in New Orleans, Louisiana, far away from his Chicago office, and on February 7, he is scheduled to present to other lawyers about the First Amendment during this same mandatory Continuing Legal Education Program. On 1 Tuesday, February 12, 2009, the Applicant’s attorney has been scheduled to conduct an evidentiary hearing at St. Martinville, St. Martin Parish, Louisiana in connection with a motion to dismiss a criminal case on the grounds that the statue is unconstitutionally overbroad in violation of the First Amendment. He is scheduled to appear in the Circuit Court of Cook County on February 17, 24, and 26, 2009 and he is scheduled to attend a professional seminar outside the United States during the period of February 27 to March 1, 2009. Accordingly, the Applicant requests that the period of time in which to file its Brief be extended by SIXTY days, until April 14, 2009.
