proceed in the interference. Accordingly, it is appropriate to enter judgment against 3
Costantino. 4

interference (Declaration (Paper 1)), is entered against senior party Costantino; 3
FURTHER ORDERED that claims 30-62 of Costantino application 4
11/792,465, which claims correspond to Count 1 (Declaration at 4), are FINALLY 5
REFUSED, 35 USC 135(a); 6
FURTHER ORDERED that if there is a settlement agreement, the parties 7
are directed to 35 USC 135(c) and Bd. R. 205; and 8
FURTHER ORDERED that a copy of this judgment shall be entered into 9
the administrative record of the Costantino involved application and the Seilz 10
involved patent. 11
