Boucher et al., the senior party (“Boucher”), requested a conference
concerning the Order Setting Motion Times pursuant to the Order entered by the
Interference No. 105,951

Board on September 27, 2012.1 The conference call was held on July 12, 2013.
Hector J. Ribera appeared for the junior party, Connery et al. (“Connery”); Michael
Siekman and Lawrence Green appeared for Boucher.
During the conference call, Boucher requested judgment in its favor
pursuant to Bd.R. 127(b). Connery indicated that it did not oppose Boucher’s oral
motion.
It is ORDERED that judgment against Connery is entered because it has
abandoned the contest. (Bd. R. 127(b)(4).)
It is FURTHER ORDERED that Judgment is entered against US 6,956,853
for counts 1 and 2, and
Claims 1-20 of US 6,956,853 are CANCELED.
