In a concurrent paper (Paper No. 146), we have denied junior party Supinski 1
Motion for Priority. In a previous paper (Paper No. 75), we also granted Cohen 2
Motion 1 asserting unpatentability of Supinski’s claims corresponding to the 3
counts, claims 1 and 3-21, under the on-sale bar of 35 U.S.C. § 102(b). Pursuant to 4
these decisions, it is: 5
ORDERED that judgment on priority as to Count 1 and 2 (the two counts of 6
the interference, Paper No. 1, p. 4) is entered against junior party ROBERT S. 7
SUPINSKI; 8
FURTHER ORDERED that Supinski’s claims corresponding to the counts, 9
claims 1 and 3-21, are unpatentable under the on-sale bar of 35 U.S.C. § 102(b); 10
FURTHER ORDERED that Supinski claims 1 and 3-7 of Appl. No. 11
10/007,812, which correspond to Count 1, are FINALLY REFUSED; 12
FURTHER ORDERED that Supinski claims 8-21 of Appl. No. 13
10/007,812, which correspond to Count 2, are FINALLY REFUSED; 14
FURTHER ORDERED that junior party ROBERT S. SUPINSKI is not 15
entitled to a patent containing Supinski claims 1 and 3-21 (corresponding to 16
Count 1 and 2) of: 17

filed November 8, 2001; 19
FURTHER ORDERED that the parties are directed to 35 U.S.C. § 135(c) 20
and Bd. R. 205 regarding the filing of any settlement agreements; and 21
