Case No. 21-RC-2277. March 14, 19593 Decision and Order Upon a petition duly filed under Section 9 (c) of the National Labor Relations Act, a hearing was held before James W. Cherry, Jr., hearing officer. The hearing officer's rulings made at the hearing are free from prejudicial error and are hereby affirmed. Pursuant to the provisions of Section 3 (b) of the Act, the Board has delegated its powers in connection with this case to a three-mem- ber panel [Chairman Herzog and Members Houston and Styles]. Upon the entire record in this case, the Board finds : The Employer, an insurance company, is engaged in selling life, accident, and health insurance and industrial casualty insurance. It is not licensed to do business in any State other than California, and is prohibited from selling any new or additional insurance to indi- viduals outside the State. It receives approximately 97 percent of its total premiums from sources within the State and 3 percent from policy holders who bought their insurance in California and later left the State. The total insurance in force is approximately $2,000,000. The Em- ployer receives annually $145,000 in premiums, of which only $5,000 comes from policy holders outside the State. In 1947, the Employer made investments amounting to $335,000, of which 66 percent was in out-of-State securities. Since 1947, the Employer has made no new investments. The Employer contends that the Board neither has nor should as- sert jurisdiction. While the Employer's operations are not unrelated to commerce, the record does not disclose that the interstate aspects of these operations are of sufficient magnitude to justify the assertion of jurisdiction under the Board's announced policy? We shall dis- miss the petition. Order IT IS HEREBY ORDERED that the petition herein be , and it hereby is, dismissed.
