JUDGMENT Termination of the Proceeding 37 C.F.R. § 42.73 IPR 2014-01470, 01483, 01488, 01492, 01495, 01496 Patents 8,004,497; 8,519,973; 6,012,103; 6,493,770; 6,249,825; 8,059,015 2 On November 21, 2014, the parties filed a joint motion to terminate these proceedings, as authorized by the Board on November 20, 2014. The parties also filed a true copy of their written agreement, made in connection with the termination of the instant proceedings, in accordance with 35 U.S.C. § 317(b) and 37 C.F.R. § 42.74(b). In addition, the parties filed a joint request to have their agreement treated as confidential business information under 35 U.S.C. § 317(b) and 37 C.F.R. § 42.74(c). See, e.g., IPR 2014-01470 (Papers 8, 9; Ex. 1008). The joint motions request termination of the proceedings and further explain that the related litigation has been dismissed without prejudice. At this juncture in the proceedings, decisions to institute trial have not been entered as the joint motions preceded the expiration for filing preliminary responses by the Patent Owner. Based on the facts of these cases, it is appropriate to enter judgment 1 without rendering a final written decision. See 35 U.S.C. § 317(a); 37 C.F.R. § 42.72. It is ORDERED that the parties’ joint request that the agreement be treated as business confidential information, to be kept separate from the patent file is granted; FURTHER ORDERED that the joint motions to terminate the proceedings are granted; and FURTHER ORDERED that the proceedings are terminated. 1 A judgment means a final written decision by the Board, or a termination of a proceeding. 37 C.F.R. § 42.2.
