Judgment - Bd.R. 127(b) -2- After the declaration of this interference Junior party Bertilsson filed a paper in the file of its involved patent statutorily disclaiming all the claims of that patent under 37 CFR 1.321(a). (Paper entered March 14, 2019). Disclaimer of all of a party’s involved claims is considered to be a request for adverse judgment. Bd. R. 127(b). On April 5, 2019, Supervisory Paralegal Andrew Kellogg contacted Matthew Pavao, counsel for Bertilsson, who confirmed that Bertilsson does not intend to contest the interference. Accordingly it is ORDERED that judgment on priority of invention as to Count 1 (Declaration, Paper 1, 6), the sole count of the interference, is entered against junior party Bertilsson; FURTHER ORDERED that the junior party claims corresponding to Count 1, i.e., claims 1, 2, 5-16 of patent 6,969,702 (Declaration, Paper 1, 6), are CANCELLED; 35 U.S.C. § 135(a);1 FURTHER ORDERED that the parties are directed to 35 U.S.C. § 135(c) and to Bd. R. 205 regarding the filing of settlement agreements; and FURTHER ORDERED that a copy of this judgment shall be entered into the administrative record of the involved junior party patent and the involved senior party application. -3- cc w/att.
