Section 361.023 - Public Policy Concerning Hazardous Waste(a) To protect the public health and environment, it is the state's goal, through source reduction, to eliminate the generation of hazardous waste to the maximum extent that is technologically and economically feasible. Therefore, it is the state's public policy that, in generating, treating, storing, and disposing of hazardous waste, the following methods are preferred to the extent economically and technologically feasible, in the order listed: (2) reuse or recycling of waste, or both;(3) treatment to destroy hazardous characteristics;(4) treatment to reduce hazardous characteristics;(5) underground injection; and(b) Under Subsection (a)(3), on-site destruction is preferred, but it shall be evaluated in the context of other relevant factors such as transportation hazard, distribution of risk, quality of destruction, operator capability, and site suitability.Tex.
