Section 4-8-305 - Monument to unborn children(a) The general assembly calls for a monument to be erected on the capitol campus as a reminder of unborn children. The monument shall be in memory of the victims of abortion, babies, women, and men.(b) One (1) member of the senate and one (1) member of the house of representatives, each appointed by their respective speaker, shall work with the state capitol commission to design and place the monument commissioned pursuant to subsection (a) at a suitable location on the capitol campus.(c) No state funds shall be spent on the construction or placement of the monument, and the monument must be erected using private funds. The members appointed pursuant to subsection (b) shall perform their duties when in Nashville for other official business.(d)(1) There is created a separate account within the state general fund to be known as the Tennessee Monument to Unborn Children fund.(2) The fund must be funded by gifts, grants, and other donations received by the state for the fund from nonstate sources.(3) Money in the fund may be used for the design, construction, and installation of the monument.(4) At the end of each fiscal year, the commissioner of finance and administration shall carry forward any amounts remaining in the fund.(5) Moneys in the fund must be invested by the state treasurer pursuant to title 9, chapter 4, part 6, for the sole benefit of the fund, and interest accruing on investments of and deposits into such fund must be returned to such fund and remain part of the fund.(6) After the completion of the monument, any moneys remaining in the fund must remain in the fund and be expended for the upkeep and maintenance of the monument until all monies in the fund are exhausted.(e) Upon completion of the monument, the state capitol commission shall name the monument the "Tennessee Monument to Unborn Children, In Memory of the Victims of Abortion: Babies, Women, and Men."
