Section 448.903a - NonapplicabilityNothing in this act shall apply to:
(1) A private contract or arrangement entered into by a consumer and caregiver, provided that the caregiver was not supplied, arranged, scheduled or referred to the consumer by a home care agency or a home care registry.(2) Any mental health and mental retardation services authorized or paid for by the Department of Public Welfare or a county mental health or mental retardation program. The provisions of the act of October 20, 1966 (3rd Sp.Sess., P.L. 96, No. 6), known as the "Mental Health and Mental Retardation Act of 1966," and all related regulations shall continue to be applicable to such services.1979, July 19, P.L. 130, No. 48, § 903.1, added 2006, July 7, P.L. 334, No. 69, § 6, effective upon publication of regulations under 35 P.S. § 448.809a at 39 Pa.B. 6958 [12/12/2009].
