Section 341.055 - Hearing; alteration of proposed boundaries(1) At the time designated in the notice given under ORS 341.045, the Higher Education Coordinating Commission or its authorized representative shall conduct a public hearing on the study and may adjourn the hearing from time to time. The commission may alter the boundaries set forth in the petition submitted under ORS 341.025 to include all territory the residents of which will be materially benefited by formation of the community college district as determined by the study conducted under ORS 341.045. The commission shall not modify the boundaries of the district as set forth in the petition so as to exclude from the district any territory the residents of which will be materially benefited by formation of the district, nor may there be included in the proposed district any territory the residents of which will not be materially benefited.(2) If the commission concludes that any territory has been improperly included or omitted from the proposed community college district and that electors within the included or omitted territory have not appeared at the hearing, the commission shall continue further hearing on the study and shall order notice given to the nonappearing electors requiring them to appear and show cause why their territory should not be excluded or included in the proposed district. The notice shall be given either in the same manner as notice of the original hearing was given or by personal service on each nonappearing elector.
