Section 1-737.10 - Injunctive reliefA. A cause of action for injunctive relief against a person who has performed or attempted to perform a dismemberment abortion in violation of Section 3 of this act may be maintained by:1. A woman upon whom such a dismemberment abortion was performed or attempted to be performed;2. A person who is the spouse, parent or guardian of, or a current or former licensed health care provider of, a woman upon whom such a dismemberment abortion was performed or attempted to be performed; or3. A prosecuting attorney with appropriate jurisdiction.B. The injunction shall prevent the defendant from performing or attempting to perform further dismemberment abortions in violation of Section 3 of this act.Okla. Stat. tit. 63, § 1-737.10
Amended by Laws 2022 , c. 133, s. 2, eff. 4/29/2022.Repealed by Laws 2021 , c. 308, s. 12, eff. on and after the certification of the Attorney General that: 1. The United States Supreme Court overrules the central holding of Roe v. Wade, 410 U.S. 113 (1973), reaffirmed by Planned Parenthood of Southeastern Pennsylvania v. Casey, 505 U.S. 833 (1992), thereby restoring to the State of Oklahoma the authority to prohibit abortion; or 2. An amendment to the United States Constitution is adopted that restores to the State of Oklahoma the authority to prohibit abortion.Added by Laws 2015 , c. 59, s. 4, eff. 11/1/2015.
