Any person who violates paragraph 7 of subsection A of Section 1005 of this title shall be guilty of a felony, and upon conviction thereof shall pay a fine of not more than three times the amount of payments (claimed or received) equaling the services which would have been reflected in the absent records or Ten Thousand Dollars ($10,000.00), whichever is greater, or be imprisoned for not more than three (3) years, or by both such fine and imprisonment. Additionally, the person found guilty hereunder shall be liable for the cost of the investigation, litigation, and attorney fees, which, in addition to all fines assessed, shall be deposited in the Attorney General's Medicaid Revolving Fund.
