Section 39:11-7 - Discretion of commission relative to junk yard, business

The commission or its representative, in connection with a request for a hearing made by a municipal governing body or zoning commission pursuant to R.S. 39:11-6, may examine the location of the motor vehicle junk yard or business proposed to be established or maintained. The commission may recommend such conditions as it deems advisable, having regard to the depreciation of surrounding property and the health, safety, and general welfare of the public.

Amended by L. 2003, c. 13, s. 69, eff. on the date the Commissioner of Transportation certifies to the Governor that a majority of the members of the commission have been appointed or are in office and that all necessary anticipatory actions have been accomplished, provided, that the amount of revenues received pursuant to sections 109 and 110 of chapter 13 prior to the date of certification are hereby appropriated to the division.
