Section 18A:7A-53.1 - Rules, regulations; procedure for 36 months following enactmenta. The State Board of Education shall adopt rules and regulations pursuant to the "Administrative Procedure Act," P.L. 1968, c.410 (C.52:14B-1 et seq.), to effectuate the provisions of this act; except that notwithstanding any provision of P.L. 1968, c.410 (C.52:14B-1 et seq.) to the contrary, the commissioner may for a period of 12 months following the effective date of P.L. 2007, c. 16, adopt, immediately upon filing with the Office of Administrative Law, such rules and regulations as the commissioner deems necessary to implement the New Jersey Quality Single Accountability Continuum. The commissioner shall engage in a collaborative process with interested stakeholders in the education community prior to the adoption of rules and regulations for the 12-month period. All such rules and regulations adopted by the commissioner shall expire no later than 12 months following the effective date of P.L. 2007, c. 16 and shall thereafter be amended, adopted or re-adopted during the following 24-month period by the commissioner in accordance with the provisions of P.L. 1968, c.410 (C.52:14B-1 et seq.).b. All such rules and regulations adopted by the commissioner pursuant to subsection a. of this section shall expire no later than 36 months following the effective date of P.L. 2007, c. 16 and shall thereafter be amended, adopted or re-adopted by the State board in accordance with the provisions of P.L. 1968, c.410 (C.52:14B-1 et seq.).Amended by L. 2007, c. 16,s. 23, eff. 1/24/2007.
