§ 747. Prohibited acts

(a) No person shall, with respect to poultry and poultry products:

(1) Slaughter, prepare, or process such products to be used as human food in any establishment processing them solely for intrastate commerce, except in compliance with the requirements of this chapter.

(2) Sell, or have or offer or receive for sale, transport or have or offer or receive for transportation in intrastate commerce:

(A) Any poultry product capable of use as human food which is adulterated or misbranded at the time of its sale, or of its possession or offer or receipt for its sale or its transportation, possession or offer or receipt for its transportation.

(B) Articles required to be inspected under the provisions of this chapter unless they have been so inspected and passed.

(3) Perform any act with respect to said articles which are capable of use as human food while they are being transported in intrastate commerce or held for sale after such transportation, which causes or has the effect of causing the adulteration or mislabeling of said products.

(4) Sell, or have or offer or receive for sale, transport or have or offer or receive for transportation in intrastate commerce or from an official establishment, any slaughtered poultry from which the blood, feathers, feet, head and viscera have not been removed in accordance with the regulations promulgated by the Secretary under this chapter, except as may be authorized by said regulations.

(5)

(A) Use to his own advantage or reveal other than to the authorized representative of the Commonwealth of Puerto Rico or other government in its official capacity, or as ordered by the court in any judicial proceeding, any information acquired under the authority of this chapter concerning any matter which is considered as a trade secret.

(B) No brand manufacturer, printer or other person may cast, print, lithograph, or otherwise make any device containing any official mark or simulation thereof, or any label bearing any such mark or simulation or any official certificate or similitude thereof, except as authorized by the Secretary.

(c) No person shall:

(1) Forge any official device, seal, mark or certificate.

(2) Without authorization of the Secretary, use any official device, seal, mark or certificate, or simulation thereof, or alter, detach, deface or destroy any official device, seal, mark or certificate, or simulation thereof.

(3) Contrary to the regulations prescribed by the Secretary, fail to use, or to detach, deface or destroy an official device, mark or certificate.

(4) Knowingly possess, without promptly notifying the Secretary or his representative, any official device, or any counterfeit, simulated, forged or improperly altered official certificate or any official device or any carcass of poultry or poultry product or part thereof bearing any counterfeit, simulated, forged, or improperly altered official mark.

(5) Knowingly make any false statement in any shipper’s certificate or other nonofficial or official certificate required by the regulations promulgated by the Secretary.

(6) Knowingly represent that any article has been inspected and passed, or exempted, under this chapter when, in fact, it has not been inspected, passed or exempted.
