§ 341a. Definitions

(a) Air contaminator. — Means dust, smoke, fumes, gases, malodorous substances, particles of material, and any combination of same.

(b) Contamination of the air. — Means the presence in the atmosphere of one (1) or more air contaminators in such amount and for such period of time which is, or tends to be, injurious to the health or human well being, animal or vegetable life, or to property, or to that which unreasonably interferes with the enjoyment of life, property or commercial or industrial operations.

(c) Source of contamination. — Means any commercial, industrial, agricultural activities or of any other nature which initiates, generates or emits any air contaminator.

(d) Emission. — Means to discharge air contaminators into the atmosphere.

(e) Person. — Means any natural or [juridical] person, either public or private.

(f) Secretary. — Means the Secretary of Health of the Commonwealth or his authorized representative.
